NEWARK, N.J. — A New Jersey judge has allowed a boat owner’s negligence and breach of contract claims to proceed against a repair facility that had control of the plaintiff’s vessel when it was severely damaged by Superstorm Sandy.
In an opinion denying the facility’s motion to dismiss to causes of action, Judge Susan D. Wigenton ruled May 22 that plaintiff Gary Lutsky sufficiently alleged facts to support his claims, which arose after the storm’s force carried his boat nearly a mile and a half from where it was being repaired.
