Adjuster Sued in Superstorm Sandy Flood Case Says Dispute is Governed by Federal Law

CAMDEN, N.J. — An independent insurance adjuster that was sued after a contractor hired to repair a New Jersey home damaged by Superstorm Sandy walked off the job has removed the case to federal court, arguing that resolution of the case rests squarely on interpretation of federal law.
In its April 18 notice of removal, Colonial Claims Corp. says the allegations in plaintiff Marjorie Brooks’ complaint are governed exclusively by flood insurance regulations issued by the Federal Emergency Management Agency, which first advised Brooks to leave her home after it was flooded by Sandy.
