Greenwich Insurance Says Anti-Indemnity Statute Bars Coverage for Chesapeake

PITTSBURGH - Greenwich Insurance Co. has filed a declaratory judgment action over a personal injury suit against Chesapeake Appalachia Inc. in which Chesapeake is seeking a defense and indemnification from Greenwich and its insureds. Greenwich Insurance Co. v. BBU Services Inc., et al., No. 2:12-cv-00291 (W.D. Pa.).
The carrier filed the action March 8 in the U.S. District Court for the Western District of Pennsylvania, naming its own insureds - BBU Services Inc. and BBU Environmental Services Inc. - as well as the parties to the underlying lawsuit, including the Chesapeake entities and plaintiffs Richard and Frank Lancaster.
