ALBANY, N.Y. - A reluctant seller has been ordered to complete a promised sale of real property despite the lack of an agreement by the buyers to prohibit gas drilling or any other activity that could be environmentally harmful. Bayly, et al. v. Broomfield, 2012 No. 512623 [2012 NY Slip Op 01532] (N.Y. Sup. Ct., App. Div., 3rd Dept.).
The New York Supreme Court Appellate Division, Third Department, affirmed a Supreme Court decision that a valid contract existed between buyers and sellers and that the buyers were entitled to specific performance from defendant-appellant Lillian M. Broomfield.
