SHREVEPORT, La. - A Louisiana appellate court has affirmed a decision allowing a firm to construct a gas pipeline across a 400-acre tract despite the owners' opposition and a lack of documentary evidence to support the firm's choice of routes. Acadian Gas Pipeline System v. Nunley, et ux., No. 46,648-CA (La. Ct. App., 2nd Cir.).
The Second Circuit Court of Appeal said in its Nov. 2 opinion that Pierce and Susan Nunley failed to disprove Acadian Gas Pipeline System's contention that the records sought never existed or that Acadian had a statutory or regulatory duty to compile them.
