WHEELING, W.Va. - A federal judge has denied a defense motion to transfer a West Virginia man's fracking injury suit to western Pennsylvania where the alleged chemical exposure occurred, finding the balance of factors weigh against transfer. Bombardiere v. Schlumberger Technology Corp., et al., No. 1:11-cv-50 (N.D. W.Va.).
Judge John P. Bailey of the U.S. District Court for the Northern District of West Virginia said in his June 14 memorandum that the Western District of Pennsylvania does not provide easier access to witnesses or lessen the parties' costs and his court is experienced in applying out-of-state tort law.
