PHILADELPHIA - A federal judge said he would allow plaintiff ship owners to depose a non-party fact witness for a second time over defendants' objections because the witness has indicated he wishes to change some of his testimony but does not want to travel to Philadelphia for an upcoming trial. In re Petition of Frescati Shipping Company Ltd., No. 05-305 and United States v. Citgo Asphalt Refining Co., et al., No. 08-2898 (E.D. Pa.).
