Defendant Disputes Deepwater Workers' Right to Bring Jones Act Claims

HOUSTON - A defendant in a workers' action arising from the BP oil spill contends in its notice of removal from Texas state court that plaintiffs improperly filed Jones Act claims in an attempt to avoid removal to federal court. Benton, et al. v. Transocean Ltd., et al., No. 4:10-cv-02765 (S.D. Texas).
Cameron International Corp. also charged in their Aug. 4 filing that plaintiffs violated a federal judge's order by filing outside of the federal court hearing Transocean Ltd.'s damages limitation action (In re The Complaint and Petition of Triton Asset Leasing GmbH, No. 4:10-cv-01721, S.D. Texas).
