Drywall MDL Plaintiffs Seek Solidary Liability Ruling in Trial Against North River

NEW ORLEANS — Federal Chinese drywall MDL Judge Eldon E. Fallon has taken under advisement a motion by plaintiffs to apply the solidary liability rule to redhibition claims asserted against sellers of the allegedly defective product. In Re: Chinese-Manufactured Drywall Products Liability Litigation, MDL No. 2047 (E.D. La.).

Judge Fallon heard argument on the issue July 26 in U.S. District Court for the Eastern District of Louisiana, where a November trial is scheduled to determine North River Insurance Co.’s obligation to cover damages arising from claims against Interior Exterior Building Supply Co.
