PHILADELPHIA — A federal judge in Pennsylvania has again rejected an attempt by plaintiffs to create a medical monitoring class to detect lung injuries caused by exposure to spray polyurethane foam insulation in their homes.
Judge Jan E. DuBois of the U.S. District Court for the Eastern District of Pennsylvania ruled Oct. 16 that the plaintiff request for establishment of a medical monitoring class failed to identify a serious latent disease that would require monitoring and what medical procedures would be initiated to detect the illness.
