HOUSTON –– A Texas appellate court has affirmed a take-nothing judgment entered in favor of a deck manufacturer, ruling that while the supplier plaintiff had established that a defect was present, it did not provide enough evidence to establish the cause of the damage.
In the Oct. 10 opinion, the Texas 1st District Court of Appeals found that there was no evidence that the deterioration of an EverGrain decking product was caused by a manufacturing defect.
