Insurer Says ‘Stream of Commerce’ Theory Applies in Nebraska Toilet Water Supply Line Case

OMAHA, Neb. –– An insurer has opposed a motion seeking reconsideration of a Nebraska federal court’s decision to retain jurisdiction over an action involving allegedly defective toilet supply lines.

In an Aug. 15 opposition filed in the U.S. District Court for the District of Nebraska, State Farm Fire and Casualty Co. argues that it has made a prima facie showing of jurisdiction under the “steam of commerce” theory.

Plaintiffs in the underlying complaint are insurers of a homeowner who contended that a polymeric coupling nut incorporated into a flexible water supply line in his home was defective and resulted in …
