MDL Judge Allows Express Warranty Claims to Proceed in Hardie Siding Cases

MINNEAPOLIS –– The court overseeing a Multidistrict Litigation docket relating to allegedly faulty siding manufactured by James Hardie Building Products has issued an order rejecting efforts by the defendant to dismiss express warranty claims.
In the July 15 order, the U.S. District Court for the District of Minnesota did, however, dismiss breach of implied warranty and negligence claims, noting that the plaintiffs had agreed to the dismissal of those causes of action.
