KB Homes Seeks to Dismiss, or Transfer, Declaratory Action Involving Insurance Coverage for Allegedly Faulty Siding

ALEXANDRIA, Va. –– Citing a lack of subject matter and personal jurisdiction, KB Home Inc. has moved to dismiss a declaratory action arising out of a dispute in coverage for underlying claims alleging construction defects with siding used by the construction company.
In a July 11 motion filed in the U.S. District Court for the Eastern District of Virginia, KB Homes contends that it has no “meaningful” ties to the state and, further, that all the questions in the insurance coverage dispute involve a construction project that occurred in North Carolina.
