Insurer Removes Declaratory Action Filed by D.R. Horton for Defense Costs Arising Out of Construction Defect Claims

LAS VEGAS –– An insurance company has removed a declaratory action filed by homebuilder D.R. Horton, who claims that its request for defense and indemnification for underlying construction defect claims asserted against the company were wrongfully denied.

American Home Assurance Co. removed the case in June to the U.S. District Court for the District of Nevada, citing complete diversity between the parties and noting that the amount in controversy exceeds $75,000.

The insurer specifically notes that it is a New York corporation, while D.R. Horton is a corporation organized under Delaware laws. Fellow defendant Liberty Mutual Fire Insurance Co. …
