Court Says Joinder of Insurance-Related Claims and Construction Defect Claims Proper; Remands Case

NEW ORLEANS –– A Louisiana federal court has remanded a case that asserted defective window claims in addition to an insurance-related cause of action, saying it is not improper for the claims to proceed together in one case.

In the July 3 decision, the U.S. District Court for the Eastern District of Louisiana opined that there are questions of law or fact that are common to all defendants since the insurance-related claims arose out of the installation of the allegedly faulty windows.
