MADISON, Wis. — The Wisconsin Supreme Court has affirmed an intermediate appellate court’s reinstatement of a suit by a residential contractor against its concrete supplier, but it dismissed all but two claims it said were assigned by affected homeowners.
Chief Justice Shirley S. Abrahamson and two justices concurred in the panel’s July 12 per curiam opinion, but questioned whether any assigned claims were being asserted. The chief justice said in a concurring opinion that she would remand without instructions to the trial court on how to proceed on that issue.
