6th Circuit Revives Breach of Warranty Claims in Ohio Trimboard Class Action

CINCINNATI — A federal appeals court has reinstated certain claims asserted in an Ohio class action against the manufacturer of an alternative wood trim product that allegedly failed before the expiration of the product’s 10-year warranty.
In a July 12 decision vacating a lower court’s dismissal of express warranty claims, the 6th Circuit U.S. Court of Appeals held that a promise of future performance that manufacturer Louisiana-Pacific Corp. made in its warranty for Trimboard renders Ohio’s statute of limitations inapplicable to the class action claims.
