Mich. Federal Judge Refuses to Dismiss Window Manufacturer’s Case Based Upon Spoliation of Evidence

DETROIT — In a breach of contract action brought by a glass window manufacturer against supplier Edgetech I.G. Inc., a Michigan federal judge has denied Edgetech’s motion to dismiss based upon spoliation of evidence.
On July 3, Judge Avern Cohn of the U.S. District Court for the Southern District of Michigan further ruled that Edgetech was not prejudiced by the destruction of evidence, which was not intentional, finding its expert was still able to form an opinion based on his examination of the preserved evidence.
