Ala. Court Dismisses Warranty, Indemnity Claims in Defective Window Lawsuit; Trial Scheduled for July 29 on Remaining Claims

MOBILE, Ala. –– An Alabama federal court has dismissed express warranty and contractual indemnity claims asserted by a subcontractor who argued that windows it was contracted to install at a new building on the University of South Alabama’s campus were defectively designed.

In the June 18 opinion, the U.S. District Court for the Southern District of Alabama did allow negligence and breach of contract claims to continue to trial, which is scheduled for July 29.

According to a July 9 order, “some progress has been made,” regarding settlement discussions, but a settlement conference is not warranted at this time. The …
