Federal Court Narrows Pa. Homeowners’ Claims Against Foam Insulation Defendants

PHILADELPHIA — A federal judge has dismissed several causes of action brought by homeowners against Barnhardt Manufacturing Co. and an installer of Barnhardt’s spray foam insulation, but denied defendants’ efforts to dismiss the class action entirely or decline jurisdiction.
Judge DuBois of the U.S. District Court for the Eastern District of Pennsylvania filed an order July 8 granting in part and denying in part motions by Barnhardt and McGlaughlin Spray Foam Insulation, but dismissed the individual causes of action without prejudice and said plaintiffs could re-plead negligent supervision, breach of express warranties and medical monitoring claims.
