WEST PALM BEACH, Fla. — A Florida appeals court has reinstated a claim for common law indemnity brought against the manufacturer of allegedly defective shower glass doors that spontaneously shattered after they were installed in a new Westin hotel.
Reversing a trial court decision to dismiss the case against Tecnoglass LLC, the Fourth District Florida Court of Appeal ruled May 22 that Diplomat Properties may pursue its claim against the manufacturer on behalf of the company that installed the doors and was later hit with a $2.5 million judgment for breaching its contract with the hotel owner.
