NEW ORLEANS — A state appeals court has affirmed an award of summary judgment to the manufacturer of a spray polyurethane foam roofing product that was blamed for causing water intrusion damage at a Louisiana office building.
In a May 15 decision, the Fourth Circuit Louisiana Court of Appeal held that the trial court’s decision to let manufacturer E.R. Systems Inc. out of the case just four days before it went to trial against the remaining defendants was not in error, especially in light of the lack of evidence supporting claims against the company.
