NEW YORK — A New York appeals court has reversed a lower court ruling that extended the statute of limitations allowing homeowners to proceed with breach of express warranty claims against the manufacturer of allegedly defective windows and doors installed in their home.
In a unanimous decision, the Appellate Division of the New York Supreme Court said April 25 that the lower court erred in determining that an offer from the manufacturer to replace parts of the windows under terms of the product’s 10-year warranty was insufficient to extend the limitations period beyond four years.
