CHARLESTON, S.C. — A federal judge has dismissed a Kansas couple’s breach of express warranty and a fraud-related claims brought against the manufacturer of allegedly defective windows they say caused water intrusion and damage to their home.
Judge David C. Norton, who presides over the MI Windows and Doors Products Liability MDL in U.S. District Court for the District of South Carolina, ruled April 9 that the couple failed to show they relied directly on any representations made by the manufacturer or that they had a contractual relationship with the company necessary to sustain the causes of action.
