S.C. Judge Permits Express Warranty Claim, Dismisses Others from GAF Timberline Shingle Class Action

GREENVILLE, S.C. — A federal judge has dismissed all but one of the claims asserted in a class action lawsuit filed by a Florida man who alleges that the Timberline-brand roofing shingles installed in his home are defective.

Judge J. Michelle Childs of the U.S. District Court for the District of South Carolina said March 20 that she would allow a cause of action for breach of express warranty to proceed against Timberline shingle manufacturer GAF Materials Corp. However, she left open the possibility that additional evidence gathered through the course of the litigation may prevent recovering under the theory.
