BIRMINGHAM, Ala. — A federal judge has rejected a lawsuit filed against SunTrust Mortgage Corp. for allegedly threatening to foreclose on an Alabama couple’s home after it was rendered uninhabitable as a result of damage caused by Chinese drywall.
In a March 4 ruling, Judge R. David Proctor of the U.S. District Court for the Northern District of Alabama awarded summary judgment to SunTrust Mortgage Corp. on all claims stemming from the alleged foreclosure, noting they ignore the fact that no foreclosure ever occurred.
