S.C. Judge Allows Warranty, Enrichment Claims Against MI Windows & Doors to Survive

CHARLESTON, S.C. — A federal judge in South Carolina has denied a motion for judgment on the pleadings filed by MI Windows & Doors Inc., which had argued that an express warranty accompanying its product precluded any liability for the plaintiffs’ allegations of breach of implied warranty or unjust enrichment.

Judge David C. Norton of the U.S. District Court for the District of South Carolina issued the ruling Feb. 4 after determining that neither MI nor the plaintiff have revealed the terms of the express warranty or included it in any of the briefing.
