NEWARK, N.J. — Plaintiffs in a class action alleging property damage and injury caused by allegedly toxic polyurethane foam insulation have opposed a motion to dismiss the case, arguing that specific misrepresentations made by the product’s manufacturer warrant preservation of their claims.
In a Feb. 20 opposition brief filed in U.S. District Court for the District of New Jersey, the lead plaintiffs maintain that an amended complaint they filed in December against Demilec USA and others easily satisfies federal pleading standards for consumer fraud, breach of warranty and medical monitoring.
