Several Claims Dismissed from Class Action Involving GAF Timberline Shingles

ANDERSON, S.C. — A South Carolina judge has dismissed the majority of claims in a class action lawsuit filed against GAF Materials Corp. for alleged defects in the company’s Timberline-brand asphalt roofing shingles.
In a Jan. 16 order and opinion, Judge J. Michelle Childs of the U.S. District Court for the Southern District of South Carolina ruled that the statute of repose barred fraud and negligence-based claims brought against GAF by class members whose shingles had cracked prematurely. Additional causes of action based on GAF’s alleged fraudulent conduct, including violation of state consumer fraud acts, were also dismissed.
