Amerisure Sues Over Coverage of Lennar Chinese Drywall Lawsuit

- MIAMI — Amerisure Insurance Co. has filed a declaratory judgment action in Florida, arguing it has no duty to defend or indemnify several subcontractors named in a lawsuit filed by the Lennar Corp. to recover the cost of repairing homes damaged by Chinese drywall.
Amerisure filed the complaint Dec. 19 in the U.S. District Court for the Southern District of Florida and maintains that coverage for the underlying suit is barred by total pollution exclusions contained in several policies it sold to companies that supplied drywall for installation in homes built by Lennar.
