Florida Judge Enters Judgment for Insurer in Chinese Drywall Coverage Suit

MIAMI — Tower Insurance Co. of New York has been awarded judgment in a Chinese drywall coverage action after the parties stipulated that the case involved damage to a Florida condominium that was not among the premises covered under Tower’s policy.
Judge Ursula Ungaro of the U.S. District Court for the Southern District of Florida administratively closed the case Dec. 10 following dismissal of Tower’s lawsuit, which sought a declaration that the insurer had no duty to defend or indemnify a homebuilder for claims asserted in a drywall class action pending in Louisiana.
