Federal Appeals Court Grants Taishan Motion to Appeal Drywall MDL Decision

NEW ORLEANS — The 5th Circuit U.S. Court of Appeals has granted Taishan Gypsum Co.’s motion for leave to appeal an interlocutory order from the Chinese Drywall MDL that allowed claims to proceed against the manufacturer in U.S. courts.
The federal appeals court issued the ruling Dec. 4, paving the way for Taishan’s argument that Drywall MDL Judge Eldon E. Fallon erred when he ruled Sept. 4 that the company’s business connections to Florida, Virginia and Louisiana were sufficient to satisfy requirements for being sued by companies and residents in those states.
