Insurer Seeks Permission to Appeal Ruling that Applied Calif. Law to Fla. Chinese Drywall Coverage Case

MIAMI — An insurer in a Chinese drywall coverage dispute has renewed its bid to appeal a ruling issued two years ago by a Florida judge who determined that the case would be decided under California law.

In a petition filed Dec. 7 in the U.S. District Court for the Southern District of Florida, Westchester Fire Insurance Co. says that its appeal of the 2010 choice-of-law ruling should be certified by the court given that the case has been stayed pending resolution of the underlying litigation.
