NEW ORLEANS — Taishan Gypsum has been granted permission to appeal a recent ruling in the MDL that required the Chinese drywall manufacturer to submit to the jurisdiction of U.S. courts.
Citing a substantial difference of opinion concerning the court’s exercise of jurisdiction over Taishan, Judge Eldon E. Fallon held Oct. 8 that Taishan had sufficient grounds to request an immediate appeal of a recent order denying Taishan’s motion to vacate default judgment and dismiss numerous claims against the company and its related entities.
