FORT LAUDERDALE, Fla. — Great American Fidelity Insurance Co. is asking a Florida judge to revisit a recent ruling that left the insurer on the hook for defense costs stemming from a Chinese drywall suit filed against a general contractor insured under one of its policies.
Great American filed the motion for reconsideration Aug. 8 in the U.S. District Court for the Southern District of Florida, claiming that the judge erroneously shifted the burden of proof to the insurer, despite determining that allegations in the underlying complaint fit wholly within exclusions contained in the policy.
