FORT LAUDERDALE - A federal judge in Florida has ruled that a contractors' job site exception to a total pollution exclusion does not create coverage for claims alleging property damage caused by Chinese drywall. Caceres Drywall Corp. v. Amerisure Mutual Insurance Co., No. 11-61427 (S.D. Fla.).
Judge William P. Dimitrouleas of the U.S. District Court for Southern District of Florida ruled March 19 that the exception is intended to apply to pollution-related damage that allegedly occurs while an insured is actively working at a job site.
