WILMINGTON, Del. - Several Florida state court plaintiffs have filed a brief in L&W Supply Co.'s federal bankruptcy case, opposing the debtor's request for entry of a discharge injunction that would effectively bar recovery for Chinese drywall claims asserted against the supplier. In re: L&W Supply Corp., No. 01-2098 (D. Del. Bkr.).
The brief, filed Nov. 18 in U.S. Bankruptcy Court in Delaware, suggests that L&W Supply, a subsidiary of United States Gypsum Co. (USG), was aware of potential Chinese drywall claims when it sought Chapter 11 reorganization and should have provided adequate notice of the claims to Florida residents …
