NORFOLK, Va. - A state court judge has been asked not to address issues of personal jurisdiction that are surrounding a motion for default judgment filed recently in Virginia against Chinese drywall manufacturer Taishan Gypsum. Allen, et al. v. Venture Supply Inc., et al., No. CL10-6976 (Va. Cir. Ct., Norfolk Cty.).
In a response brief filed Oct. 13 in Norfolk City Circuit Court, the plaintiffs contend that an inquiry by the state court into whether the Virginia court has jurisdiction over Taishan would be disruptive to ongoing discovery on the same issue in the federal Chinese Drywall MDL.
