MIAMI - The judge overseeing the coordinated Chinese drywall docket in Miami-Dade County has denied an omnibus motion to dismiss claims asserted against suppliers of the allegedly defective import. In Re: Chinese Drywall Litigation, No. 09-200000-CA-42 (Fla. Cir. Ct., Miami-Dade Cty.).
Judge Joseph P. Farina issued the order Oct. 13, rejecting the suppliers' argument that the plaintiff homeowners had failed to state a cause of action upon which relief may be granted and that any duty related to the drywall did not expand beyond the product's manufacturers.
