MIAMI - A federal judge in Florida has ruled that Amerisure Mutual Insurance Co. has no duty to defend CDC Builders Inc. against numerous lawsuits filed against the builder for Chinese drywall-related property damage and personal injury. CDC Builders Inc. v. Amerisure Mutual Insurance Co., No. 10-21678 (S.D. Fla.).
Judge Alan S. Gold of the U.S. District Court for the Southern District of Florida ruled Aug. 16 that a pollution exclusion contained in the Amerisure policies issued to CDC barred coverage for the drywall claims, even where the exclusion contained a contractor job site exception.
