Alfa Insurance Co. Sues Builder over Coverage for MDL Drywall Class Claims

HATTIESBURG, Miss. - A commercial general liability insurer has filed a lawsuit in Mississippi, claiming it has no obligation to cover allegations included in a class action against a dissolved builder that allegedly used Chinese drywall in construction of a class member's home. Alfa Insurance Co. v. KBS Construction Company, Inc., et al., No. 11-160 (S.D. Miss.).

Alfa Insurance Co. filed the complaint Aug. 2 in U.S. District Court for the Southern District of Mississippi requesting a determination that coverage is unavailable for the homeowner's allegations asserted as part of an omnibus class action brought in the Chinese Drywall MDL …
