MACON, Ga. - A federal judge has dismissed a drywall coverage action in Georgia after determining that a builder previously dismissed from the case for lack of jurisdiction was an indispensable party. Owners Insurance Co., et al. v. Rightway Drywall Inc., No. 09-374 (M.D. Ga.).
Judge Hugh Lawson of the U.S. District Court for the Middle District of Georgia granted a motion by Rightway Drywall to dismiss the case June 22, after the drywall supplier argued that it was likely the builder would face undue prejudice if the case were to proceed in its absence.
