Insurer Takes 2nd Shot at Drywall Coverage Action Against Church

HATTIESBURG, Miss. - Months after its case was dismissed for lack of jurisdiction, an insurer has re-filed a declaratory judgment action against a Mississippi church that sought coverage for damage caused by Chinese drywall. Alfa Insurance Corp. v. Praise Tabernacle Holiness Church, No. 11-104 (S.D. Miss.).
Alfa Insurance Corp. filed the new complaint May 2 in U.S. District Court for the Southern District of Mississippi, claiming Chinese drywall is not a covered cause of loss under the Church Insurance Policy and builders' risk endorsement it sold Praise Tabernacle Holiness Church.
