NORFOLK, Va. - Erie Insurance Exchange has filed a lawsuit in Virginia, asking a state court judge to declare that it has no duty to defend or indemnify an insured for personal injury and property damage allegedly caused by Chinese drywall. Erie Insurance Exchange v. Davenport, et al., No. C41-2426 (Va. Cir. Ct., Norfolk Cty.).
The March 25 complaint filed in Norfolk County Circuit Court contends that the pollution and "your work" exclusions contained in commercial general liability policies issued to Chilham Construction LLC bar coverage for Chinese drywall claims.
