WEST PALM BEACH, Fla. - A state court judge in Florida has ruled that homebuilders did not have a duty to test drywall prior to installation in homes, or to warn others about any latent defect in the product unless it had actual or implied notice that drywall was defective. Bennett v. Centerline Homes Inc., et al., No. 50 2009 CA014458 (Fla. Cir. Ct., Palm Beach Cty.).
