ORLANDO, Fla. - An Illinois-based insurer has filed a declaratory judgment action against a Florida homebuilder, claiming it has no duty to defend or indemnify the company against claims related to Chinese drywall damage in a Volusia County home. Castlepoint National Insurance Co. v. Intercoastal Construction Co., et al., No. 11-215 (M.D. Fla.).
In a Feb. 9 complaint filed in U.S. District Court for the Middle District of Florida, Castlepoint National Insurance Co. contends that several exclusions in the policies it sold Intercoastal Construction Co. bar coverage for injury and damage caused by defective drywall.
