NORFOLK, Va. - Several insurers have been dismissed from a Virginia Chinese drywall case after they argued that they had been misjoined to the case and that the claims against them had nothing to do with those asserted against other defendants in the case. Talbot v. Oxfordshire LLC, et al., No. CL10-3893 (Va. Cir. Ct., Norfolk Cty.).
Norfolk County Circuit Court Judge Mary Jane Hall issued a ruling Jan. 3, dropping the insurers from the drywall action based on a Virginia statute that prohibits plaintiffs from joining carriers simply because they provided coverage to another defendant named in the lawsuit. …
