JPML Holds Firm on Keeping Insurance Cases Out of Drywall MDL

WASHINGTON, D.C. - The Judicial Panel on Multidistrict Litigation has once again rejected an attempt to send an insurance coverage action to the Chinese Drywall Products Liability MDL in New Orleans. Lennar Corp., et al. v. Nautilus Insurance Co., No. 10-21909 (S.D. Fla./JPML).
In their latest decision denying transfer of a Florida drywall-related declaratory judgment action, the JPML on Nov. 29 recited identical reasons as they have on more than a half dozen prior occasions when faced with similar requests to include coverage cases in MDL 2047.
