Plaintiffs Want 2008 Defects Suit Kept Out of Ala. Chinese Drywall Docket

BIRMINGHAM, Ala. - Plaintiffs who filed a construction defect lawsuit in 2008 and later amended the complaint to add Chinese drywall-related claims have moved to be excluded from any coordinated proceedings that may be established for similar cases in Alabama. Burson, et al. v. Vintage Homes LLC, et al., No. CV-2008-00317 (Ala. Cir. Ct., Jefferson Cty.).

The plaintiffs filed their motion Nov. 4 in Jefferson County Circuit Court after being grouped with numerous other drywall cases pending before Judge Michael G. Graffeo, who is expected to formally consolidate the cases later this year.
